Selling with tunes
Hi
I couldn't find a particular topic for this, but please let me know if it should go somewhere else.
I just wanted to find out what would happen if you tried to sell an iPod on eBay - or anywhere else - and wanted to include all the music on it as a unique selling point.
Presumably, it's too risky as it is essentially pirating music for profit, but wanted to be sure.
I thought about putting something in the advert like:
"All these tracks can be wiped off in an instant, and obviously all music that
you don't own should be taken off when you get it, because home-taping is killing music. And it's illegal."
Would that make any difference?

Why make life difficult? Just wipe the music off...If they already own the music themselves, loading it onto the Pod with iTunes is simple enough.

I have seen a lot of ipods on ebay that say that they will leave the music on. Some say that they are leaving the music on to prove that the ipod works and after testing should be deleted. Some just list the music like it is an included extra. Probably not something that you would get in trouble for but it could happen.

Oh, I see. No, I understand that. I'm just trying to get as high a price for it as possible. I've bought a 4th gen one now, so want to sell my old one, and with so much competition out there, I thought leaving desirable music on there might help get a buyer.
What's the legal situation with that?

I'm pretty certain that if eBay caught on to what you were doing, they would shut down the auction. I believe the only way you'd be safe is if you included the original CDs for all the pre-loaded music along with the iPod.
Also the RIAA would not be too happy about it, and given their litigous history it's not something I would bother risking (despite the tremendously low chance of anything actually happening).
Plus it's doubtful that the preloaded music would make the iPod worth much more anyway. Unless you've ripped the music at exceedingly high bitrates or as lossless audio files, most people with enough computer savvy to use eBay can also use WinMX or eDonkey to get the music themselves (and thus would not pay a large premium to get the music from eBay).
