My Click wheel is acting up

So I got a new Ipod and it worked just fine for a few hours, then the click wheel stopped working. After fiddling with it for a while i discovered if I hold down the fast forward button while doing other stuff regularly it works marginally. I tried calling apple but when I gave them my serial number, they said it was already registered to someone else, so apple was no help. What do I do? Anyone else have this problem and was able to fix it?

This was happening to our 4G (sort of) over the last week and what seems to work is to first reset then, holding the iPod by the sides, toggle the hold switch back & forth. Then the scroll function works. It has been working consistently, even after sleeping, for the last few days, so hopefully the click wheel has recalibrated. Apparently if you are touching the click wheel when you put the iPod on hold, it calibrates to your fingers and not the air...whatever, it is all Greek to me. The "genius" at the Apple Store told us how to do this and it has worked pretty consistently.

My menu button broke and its been in for repair for a week now, called them today and they told me nothing was wrong with it. I do hope the man was ill informed, because i don't want it to be sent back to me with the same problem & most probably some extra scratches to add insult to injury.
