Right now the RIAA is going after people offering lots of songs to be downloaded. They are not going after people doing the downloading, just those offering it up. For the RIAA to track someone illegally downloading music, the RIAA would have to set up a computer with songs on it and the track the people who are downloading from their computer. The problem with is that since the RIAA owns the music, they have every right to give it away and therefore it wouldnt be illegal to download music from their machine.. kind of a catch 22.

So for right now, the RIAA is trolling around p2p sites, looking up popular music that they own, downloading that song and then "pinging" the computer they found it one to see how many songs are there and get the IP address of that computer.

As long as you are not the one distributing large numbers of MP3s to the general populace, you should be safe. Keep them for yourself, and don't set up a "Hey Download From Me!" web site. ;)

I don't use those sites, myself, but I do have a healthy number of live bootlegs obtained somewhat privately. ;)

Actually, the RIAA has nailed folks who have had LESS than a dozen songs available for sharing. While they are concentrating on the big sharers they are going after the little ones just to scare the bejesus out of folks. Also, I see no catch 22 there. They certainly could (and very well may be) making songs available for download and then crying wolf when enough folks do it (though it smacks of entrapment). They are also keeping track of songs available for download and comparing the hash codes from the ones they know to be illegal with hash codes on ones available for download (potentially from the songs THEY make available). Once they get enough of that kind of info to show an IP address has lots of illegal music, they will file suit against it. Happily, it seems to be having little effect on the P2P community.
If powerrangerz87 wants to be absolutely 100% safe, don't use P2P, If you want to be 95% safe, leave file sharing off and if you don't care and want to play the numbers, share away!
