Should I be losing 1/2 battery charge overnight, while off ?

Ok I've had my iPod about 10 days now.

I charged it fully last night from 8-10:30... turned it off and left it alone. Woke up this morning and needed to transfer some songs to it... plugged it in and saw the battery meter was already below 1/2...

Should I be losing 1/2 the battery charge overnight w/o it being on??

I would do a test on it and see if the battery meter is correct before you go and return it. Go to a playlist or album on your iPod and let it play over and over for as long as it takes for the battery to run out. It should take 8 hours. If it takes less then 7, return it.

Yeah, test your battery. When I leave it charging overnight the battery meter is sometimes not full when I turn it on in the morning. This is because the battery meter is so inaccurate in firmware 2.1 (they need to make more firmware updates!). Anyway, after I play it for a little bit, it goes back up to full where it should be.

If it stays like that then sure go return it and get a new one.

I listened to songs for about an hour after posting this message and when I looked at it when turning it off the battery meter was almost full...

i guess Naediel is right.
