I was jipped 3 Gigs
I have a 40 gig IPOD, but it shows capacity at 37.1... Whats the deal?

Hardware and software makers calculate file sizes and capacity differently, they have different definiations of what a megabyte is so this is perfectly normal and is the case for pretty much every hard drive. Look in the faq.

Yup.
The problem is that to technical people 1 GB = 1024MB, to marketing people 1 GB = 1000MB.
So the numbers are out in that respect.
You also have to consider that the OS (maybe in flashROM?), calender, games, contact list software, etc... comes preloaded and takes up some space.

Yeah, the "OS" takes up about 25mb.
Don't worry though, all of the iPod hard drives are like that. My "20 gig" is 18.5. Doesn't really bother me

Also when they format that hardrive and give it a file system it will loose a bunch of it's original capacity. So the actual 'hard drive' may be closer to 40GB but when formatting and adding a file system it takes away from the max. capacity (although it doesn't show that it used any)
And as Payton mentioned earlier, the OS takes space.

Any hard drive, anywhere, doesn't hold its advertised capacity, for the reason stated above: 1024 /= 1000. Try it with your computer's hard drive, or a firewire drive. For example, my 60GB external is only 57.7 when completely empty.

Yes, there is always a loss of some space due to formatting. Just have to deal with it...

And it's not something specific to iPods--it's all hard drive. The majority is due to the differences used to calculate a MB. Very little is taken up by the file system files or the OS.
And in case you think it's not fair--or that it's deceptive marketing, the hardware industry is currently being sued (apple among them) for this. 'Course the suits (http://loosewire.typepad.com/blog/2003/09/news_lawsuits_o.html) are very old--but I'm sure they're still going on.

which I think is funny, since hardware manufacuters are the ones using the SI notation correctly, while OS's use them incorrectly. Oh wel...

and rember that the 720/800 k floppy was actualy 1 meg and 1.44/1.(6 i think it was) were actualy 2 meg. and sence computer are base 2 then 1024 is corect not 1000. I have been in the support indrustry for 6+years and I think that that law suit has been going on for at least the last 3. What I find totaly funny is that for as lomg as I can recall adverts have alwase said "unformated capicty ..." and have for at least the last 3-4 years stated in the ad if thay were base 2 (1024) or base 10 (1000)
>>>added<<<
Oh one more thing as drivers get larger the delta ( er i think that is corect stats was a long time ago) between base 2 and base 10 becomes more and more apperent.
fyi my 15gig come up as 14,924,361,728 (13.8 GB)
