Podcasts and smart playlists

I now have lots of podcasts on my iPod and I would like to build a smart playlist that would only display the podcasts that I have not heard.

When I try to build the playlist it appears that the podcasts are ignored by the smart playlist.

When I set the smart playlist genre to contains "Podcast" the folder is empty even though the podcast folder has 30 files.

My plan was to create the play list with
"genre contains podcast and play count less than 1"

Is there a work around for this?

I wonder if this has something to do with the Podcast's seemingly being "outside" the music library, at least the ones downloaded from iTunes...

In the settings there is an option to only keep unplayed episodes... Also a blue dot signifies that the pod cast hasn't been played.

I can't think of or see a work around for this at the moment... Sorry.
