I just got my Ipod from smalldog.com and the only way that it will turn on is if I have it pluged into the outlet on the wall or in the computer.
I have tried charging it for hours and then taking it off so that it can be portable and it won't turn on.
and when it is on and then I take out the firewire port the ipod will turn right off and can't turn it back on untill the wire is pluged back into the computer or the wall.
Please someone help me figure out what is wrong

Just to eliminate the obvious: you ARE attempting to actively turn it on (clicking "menu" or "play"), right? As opposed to expecting it to turn on automatically, as it might when you plug it in.
Did you try to hold "play" and "menu" down simultaneously for a few seconds? This will reboot the iPod.
Otherwise, I would guess something's wrong with the battery and suggest you exchange it under warranty.
