It would seem you are less than happy with your G3 iPod, but such 'rants' are not helping your problem!
There are a lot of happy G3 owners, although they all seem to be over the pond ;) , and there may well be a problem with EU capping of "our" iPods, but there are steps to take before you burn your iPod on the steps of Cupertino!!
If you feel that badly about it and your iPod is still under warranty and you send it in believing it is faulty, Apple can't bill you if they find nothing wrong.
Just quote them "The Sale Of Goods Act 1979(as amended)"-
The Sale of Goods Acts lay down several conditions that all goods sold by a trader must meet. The goods must be:
?of satisfactory quality
?as described
?fit for purpose

'Satisfactory quality' covers minor and cosmetic defects as well as substantial problems. It also means that products must last a reasonable time. But it does not give you any rights if a fault was obvious or pointed out to you at point of sale.

'As described' refers to any advertisement or verbal description made by the trader.

'Fit for purpose' covers not only the obvious purpose of an item but any purpose you queried and were given assurances about by the trader.

If something you buy from a trader does not meet these conditions, you are first and foremost entitled to have the goods repaired or replaced.
If these remedies are inappropriate, then you are entitled to a suitable price reduction, or to return the goods and get a refund (reduced to take account of any wear and tear).

Do a "Google" on 'Sale of Goods Act' for more info - if you can I'd try for a refund, then go and get a G2 20gb iPod off eBay or somewhere.

(BTW - how on earth did your nephew(?) throw your original iPod out the car!!??)

I really think that if Apple has been forced into capping the EuroiPod because of a French law, the way to bring it to Apple's attention that it should not affect other European countries, is to write to them. If every G3 iPod owner in Euroland wrote enough times they may take heed.

I seem to recall hearing about an issue in France where the volume on the iPod was to loud and the French were making Apple cap the volume lower than originally planned. I think that's what he is talking about.
As for the nephew dropping the iPod out of the window, he should have followed it...

Thats y im sending it back for reapir to make sure that it is a fault, if it is, ill retract all i said about the new ipod. If it isn't a fault and all of the gen3 ipods are the same across the board, then i dont think u can honestly say to me that the new ipod is a worthy upgrade from the original in terms of sound quality and volume. Im glad your an old ipod owner because u can make the comparision and hear the difference yourself.

The only reason I think u are reaplying to my post is that u are affraid of admiting the new ipod u have is worse than the old one. I think u are affraid of admitting this because u think u might of wasted alot of cash on an inferior product. After u make a response to this post I only ask u to make an honest response from the heart (or ear!!!) then talk to me!!

Heh, well that's not how I use it. :)

Anything that is newly released usually always has some sort of bug and over time is fixed. So i trust Apple, and I'm pretty sure they'll fix the bugs in the new software. Even though my G3 iPod doesn't really screw up like the ones i've read bout here. Before the 2.0.1 update it used to freeze once in a while, but after the update it doesnt do that anymore. I guess i'm lucky.

i'm with u James, I love my G3 iPod and I think its superior to the G2 iPods...

At the time there was genuine concern about the battery life, and I was probably quite vocal about it.
But Apple seemed to grasp the nettle and do something about it, probably proving it was, in the majority of cases, a power management glitch as opposed to an actual battery fault.
I was down to 4 hrs at one point and despairing at the lack of any positive action from Apple, but now with the latest releases I am happy again.

Problems? Only the bit breaking off the earphone socket recently. Apart from that, I have been more than happy with my iPod.

I can sympathise with people who have had problems though - I paid ?349 ($523) for it, and it was an expensive purchase for a music player. But it has introduced me, albeit virtually, to a great community and endless cheap holiday residences ;)

Now if you got it from Apple direct you could be in for a fight to get a refund but if you read up on the Act, you should have extra ammo.
I personally have never had to use the Act, but I do know people who have and succeeded in their case, usually at the 'shop' level, but you may need further advice from the somewhere like Citizens Advice.
I'm not a consumer law expert, but don't let them fob you off with excuses - stay polite but forceful and if you sound like you know what you're talking about they may well give in!
